Should I Blow, or Refuse?
We can always challenge the results of these tests (especially since there are several different things that officers are supposed to do when administering these tests that are often not done, or not done properly); however, you can always politely refuse to do these tests, and maintain that you haven’t done anything wrong. Another thing – the answer to the biggest question out there for all DUIs: “Should I blow, or refuse to blow?” Well, just in case you missed the beginning of this message – DON’T BLOW!
The Less the Better
When we say, “the less the better” we mean it. When an officer suspects that you’ve been drinking (or using drugs), he/she will ask you to exit the vehicle and perform various SFSTs (standard field sobriety tests). The most common of these SFSTs are the HGN test, the walk-and-turn test, and the one-leg stand.
"Raise One Leg and Count Out Loud"
The one-leg stand, where the officer asks you to raise one leg and count out loud (typically to 30, by one thousand, i.e. one one thousand, two one thousand, etc). This is an abbreviated description of each of these tests, but you get the point. These tests can be very difficult if you’ve been drinking or using drugs.
